The Former President's Framework of Consequences and Incentives

Trump's insatiable urge for payback has quickly morphed into a methodical apparatus. Within the twelve months, the chief executive's fury and caprices have adopted the guise of official policies in ways comparable to earlier authoritarian systems. Federal figures who do not cooperate are immediately fired and replaced by devotees. Critical officials who question him face legal action, judicial process and penalties. Opponents have been designated under executive memoranda as “unpatriotic”, “opposed to religious values” and “against free markets”, and threatened with legal action as “security threats”.

Government Institutions Remade

All case involving prosecution of Trump's enemies and protection for loyalists displays its own distinct qualities. But, despite their individual nature, they embody expressions of what has arisen as a calculated method. Such episodes are anything but random. Trump's purge of DoJ lawyers and law enforcement agents, coupled with his placement of loyalists in high-level roles, began quickly, soon assumed a consistency, and has now been molded into a regime. The justice department and the FBI have been transformed into partisan organizations under his explicit orders to execute his demands. Unfairness has been made standard. It represents the system of punishment.

Administration is more concerned with punishing the chief's perceived opponents than they are with defending our country's safety.

Within the Apparatus

The origin of this system has been revealed in the lawsuit of several previous senior Federal Bureau officials lodged in late summer in the US district court in the capital against agency head Kash Patel and top lawyer a key figure for unlawful firing in “a effort of payback against the officials for what the accused judged to be a failure to demonstrate adequate political loyalty”. According to the filing that Brian Driscoll, the ex- acting FBI director, describes a discussion in which he “publicly confessed the unlawfulness of his behavior”.

The official had attempted to protect law enforcement officers from being terminated, the complaint states. The director informed him that “administration officials” – understood by the official to be the presidential administration and justice department – had ordered him to fire all those who they determined as having worked on a law enforcement case against Trump. The filing adds: “Patel explained that he had to fire the personnel his bosses told him to dismiss, because his capacity to hold his own position relied on the dismissal of the personnel who were involved in investigations involving the President. Patel explained that there was no option he or Driscoll could do to prevent these or any other terminations, because ‘the FBI attempted to place the President in jail and he remembers.’” After he informed him he was violating the agency's own policies, the director allegedly said “he knew that and he knew the nature of the immediate dismissals were likely unlawful”.

Broad Impact

Since the director's alleged confession to him, the DoJ and the FBI have been weakened and reorganized for Trump's revenge apparatus. Six of the FBI's senior executives were fired or forced out in the early weeks of the government. Approximately numerous lawyers at DoJ have accepted a “deferred resignation program”. At least several government attorneys, among them those in the southern district of New York, quit in dissent over what they regarded as partisan influence in withdrawing the legal action against the New York City mayor, Eric Adams, in exchange for his cooperation with the administration's ICE roundups of immigrants. The public integrity section of the justice department, which oversees ethical violations, has been reduced to minimal staff. The equality section has been devastated: seventy percent of its employees has departed. A third of top officials at the justice department have left. The unit enforcing ecological regulations has seen departures of a majority its supervisors.

Incentives and Sanctions

Concerning the mayor's situation, the temporary lawyer for the federal division, the official, quit in protest against what she characterized as the “trade-off”. The border official, the president's “border czar,” showed up as the enforcer with him on television to announce: “Unless he complies, I'll be back in New York City.”. And, another figure, formerly the acting deputy attorney general and a ex-lawyer, who brokered the deal, was given an appellate federal judgeship, a potential stepping stone to the supreme court.

Trump's immunity for crimes committed while in power, granted by the remarkable decision of the GOP-led on the supreme court, thus thwarting his legal action over the January 6 insurrection and maintaining his electoral prospects for the presidential race, is the basis on which he relies to protect his supporters. Under these circumstances, he has been empowered to enable wrongdoing. The consequence of the court judgment infuses his administration and the Republican Party down to its bones. Trump v United States has escalated. In the words of the former president's administration lawyer John Dean remarked about the Watergate
